Terms and conditions
In effect since September 6, 2026These terms govern the use of escaliti.com, the free audit we offer on the site, and the services we deliver to our clients.
By using the site or requesting an audit, you accept them. If you hire a service, the proposal you sign is added to these terms.
1. Who we are
Escaliti is a brand of SiemprePro SpA, Chilean tax ID (RUT) 78.117.275-8, a corporation organized in Chile, with offices at Cerro El Plomo 5931, office 1213, Las Condes, Santiago, Chile. In this document «we» means SiemprePro SpA and «you» means whoever uses the site or hires our services.
2. The free audit
We offer a free diagnosis of a business's digital presence. It is genuinely free: we don't ask for a card and it doesn't commit you to anything.
- It is built from public information, automatically. It may be incomplete, out of date, or wrong, and sometimes we can't measure everything. When that happens, the report says so instead of inventing the number.
- The score and any dollar figure it shows are an estimate built on assumptions the report displays. It is not an appraisal, not a financial audit, and not a promise of results.
- The decisions you make from the report are yours. Read it as a second opinion, not a verdict.
- There is a daily cap on audits and a maximum per email address. We may refuse or cancel a request, especially if it looks automated or the address does not exist.
- The report is published at a private link that expires. If you need it later, write to us.
3. The services
We provide digital marketing, automation, artificial intelligence, and software development services for businesses. The specific scope of what you hire, with its price and deadlines, is set out in the proposal we sign with you.
If anything on the site does not match your proposal, the proposal governs. The site describes what we do in general; your proposal describes what you actually hired.
We work to a professional standard with diligent effort. Part of the outcome depends on third parties we do not control, such as search engines, social networks, and ad platforms. A change of algorithm, an account suspension, or a policy change at those platforms is not a breach by us, though we will do what is reasonable to adapt.
4. Price, billing, and minimum term
- Prices are those in your proposal.
- The service is billed monthly in advance.
- The initial minimum term is three months. After that, the relationship continues month to month.
- Ad spend is paid by you, directly to the platform. We do not charge a percentage of it.
- Prices may be adjusted once the initial term is complete, with thirty days' notice. If you don't accept the adjustment, you may terminate at no cost before it takes effect.
- If a payment is more than fifteen days overdue, we may suspend the service after notice, and resume once it is settled.
5. How it ends
- Either party may terminate with written notice to contacto@escaliti.com, thirty days in advance, once the initial three-month term is complete.
- The current month is delivered in full and is not prorated.
- There is no refund for months already paid and delivered.
- We may terminate immediately if our services are used unlawfully, or if a payment is more than sixty days overdue.
6. What each side brings
You agree to:
- Give us truthful information and the access needed to work.
- Respond within a reasonable time to what we need to move forward.
- Hold the rights to the material you hand us: photos, copy, logos, and trademarks.
We agree to:
- Deliver the service with professional diligence and on the agreed timeline.
- Keep what we learn about your business confidential.
- Tell you when something isn't going to work, rather than waiting for you to notice.
7. Who owns what
- The accounts, profiles, domains, campaigns, and content we create or manage for you are yours. They are yours from day one, not from the day the relationship ends.
- When it ends, and once the final month is paid, we transfer administrative access within fifteen business days and stop using it. If you'd rather we transfer it to another provider, we will.
- Our methods, templates, processes, software, and internal tools remain ours and are not transferred. You receive the result of the work, not the tool it was made with.
- We may name you as a client and show anonymized results from your project, unless you ask us in writing not to. Saying so is enough.
8. Confidentiality
Both parties agree to keep the other's non-public information confidential and to use it only to perform this relationship. The obligation survives for two years after the service ends.
It does not cover information that was already public, that a party already lawfully knew, or that must be disclosed by order of an authority, in which case the other party is notified if the law allows.
9. Liability
- We do not guarantee specific commercial results. No serious provider can guarantee how many customers you will win.
- Our total liability to you is limited to the amount you paid us in the three months before the event giving rise to it.
- We are not liable for lost profits, lost business opportunities, or indirect damages.
- None of the above limits our liability for willful misconduct or gross negligence, which by law cannot be limited, nor liability for personal injury.
10. Acceptable use of the site
By using the site you agree not to do any of the following:
- Automate audit requests or try to get around the limits we apply.
- Request audits of sites you don't own in order to bother their owner.
- Try to reach parts of the system that are not public, or other users' data.
- Use the site for any unlawful purpose.
We may block access for anyone who does any of those things, without prior notice.
11. Changes to these terms
We may update them. The version in effect is always the one on this page, dated at the top. For a client under an active contract, a substantial change is announced thirty days in advance and, if you don't accept it, you may terminate at no cost before it takes effect.
12. Governing law and courts
These terms are governed by the laws of Chile. Any dispute is submitted to the ordinary courts of the city of Santiago, Chile.
If you hire us from another country, the proposal may agree on a different governing law or forum for that relationship. Absent express agreement, this section governs.
This document exists in Spanish and in English. The Spanish version is the binding one, and it prevails if the two differ.
